On the 23rd, the official website of the Ministry of Housing and Urban Rural Development issued a notice on the implementation of the 2019 Housing and Urban Rural Construction System "Safety Production Month" activity, requiring:

Deeply implement the "Regulations on Safety Management of Divisional and Subdivisional Projects with High Hazards", and strengthen safety control of hazardous projects.

Strengthen the supervision of accident prone and frequent areas and enterprises, and strictly supervise law enforcement.

Special training will be conducted on key topics such as safety management of hazardous engineering projects, preparation of special construction plans, and expert argumentation.

Dangerous engineering projects, including foundation pits, templates, lifting and hoisting, scaffolding, demolition, and excavation projects, have always been the hardest hit areas for safety accidents, and every occurrence is a major accident! So it is important to pay sufficient attention.

In March 2018, the Ministry of Housing and Urban Rural Development issued the "Regulations on Safety Management of Sub projects with High Risk".

In May 2018, the Ministry of Housing and Urban Rural Development issued another document clarifying the scope of hazardous projects and the content of special construction plans.

Regulations on Safety Management of Divisional and Subdivisional Projects with High Risk

Chapter 1 General Provisions

Article 1 These Provisions are formulated in accordance with the Construction Law of the China, the Production Safety Law of the China, the Regulations on the Administration of Safe Production of Construction Projects and other laws and regulations in order to strengthen the safety management of subdivisional and subdivisional projects with greater risks in housing construction and municipal infrastructure projects and effectively prevent production safety accidents.

Article 2:These regulations are applicable to the safety management of high-risk sub projects in housing construction and municipal infrastructure projects.

Article 3:The term"high-risk sub projects"referred to in these regulations refers to sub projects that are prone to causing mass casualties or significant economic losses during the construction process of housing construction and municipal infrastructure projects.

The scope of major hazardous projects and those exceeding a certain scale shall be formulated by the competent department of housing and urban-rural development under the State Council.

The provincial competent department for housing and urban-rural development can supplement the scope of high-risk projects in the local area based on the actual situation.

Article 4:The competent department for housing and urban-rural development under the State Council is responsible for guiding and supervising the safety management of major hazardous projects nationwide.

The competent departments for housing and urban-rural development of local people's governments at or above the county level are responsible for the safety supervision and management of major hazardous projects within their respective administrative regions.

Chapter 2 Early Support

Article 5:The construction unit shall provide truthful, accurate, and complete engineering geological, hydrogeological, and surrounding environmental information in accordance with the law.

Article 6:The surveying unit shall explain the engineering risks that may be caused by geological conditions in the surveying documents based on the actual situation of the project and the surrounding environmental data of the project.

The design unit should indicate in the design documents the key parts and links related to hazardous projects, propose opinions to ensure the safety of the surrounding environment and construction of the project, and conduct special designs if necessary.

Article 7:The construction unit shall organize survey, design and other units to list the list of major hazardous projects in the construction bidding documents, and require the construction unit to supplement and improve the list of major hazardous projects and clarify corresponding safety management measures when bidding.

Article 8:The construction unit shall, in accordance with the provisions of the construction contract, promptly pay the technical measures fees for the construction of hazardous projects and the corresponding safety protection and civilized construction measures fees to ensure the safety of the construction of hazardous projects.

Article 9:When applying for safety supervision procedures, the construction unit shall submit a list of major hazardous projects and their safety management measures.

Chapter 3 Special Construction Plan

Article 10:The construction unit shall organize engineering and technical personnel to prepare a special construction plan before the construction of a major hazardous project.

For the implementation of construction general contracting, the special construction plan shall be organized and prepared by the construction general contracting unit.For hazardous projects that are subcontracted, special construction plans can be organized and prepared by relevant professional subcontracting units.

Article 11:The special construction plan shall be reviewed and signed by the technical leader of the construction unit, stamped with the official seal of the unit, and reviewed and signed by the chief supervising engineer, and stamped with the practicing seal before implementation.

If hazardous large projects are subcontracted and a special construction plan is prepared by the subcontracting unit, the special construction plan shall be jointly reviewed and signed by the technical leader of the general contracting unit and the technical leader of the subcontracting unit, and stamped with the unit's official seal.

Article 12:For hazardous large projects exceeding a certain scale, the construction unit shall organize an expert discussion meeting to discuss the special construction plan.For the implementation of construction general contracting, the construction general contracting unit shall organize an expert demonstration meeting.Before expert argumentation, the special construction plan should be reviewed by the construction unit and the chief supervising engineer.

Experts should be selected from the expert database established by the local people's government's housing and urban-rural construction department, meeting professional requirements and with a minimum number of 5.Personnel with interests in this project are not allowed to participate in expert argumentation meetings as experts.

Article 13:After the expert argumentation meeting, a argumentation report shall be formed to propose a consensus on whether the special construction plan is approved, modified, or not.Experts are responsible for the argumentation report and sign for confirmation.

If the special construction plan needs to be modified and approved after argumentation, the construction unit shall modify and improve it according to the argumentation report, and then fulfill the procedures of Article 11 of this regulation again.

If the special construction plan is not approved after argumentation, the construction unit shall reorganize the expert argumentation according to the requirements of this regulation after modification.

Chapter 4 Site Safety Management

Article 14:The construction unit shall publicly announce the name, construction time, and specific responsible personnel of the hazardous project in a prominent position on the construction site, and set up safety warning signs in the hazardous area.

Article 15 Before the implementation of the special construction plan, the preparation personnel or project technical leader shall disclose the plan to the construction site management personnel.

The construction site management personnel shall provide safety technical disclosure to the operators, and both parties and the full-time safety production management personnel of the project shall jointly sign and confirm.

Article 16:The construction unit shall strictly organize construction in accordance with the special construction plan and shall not modify the special construction plan without authorization.

If adjustments are necessary due to planning adjustments, design changes, etc., the revised special construction plan shall be re reviewed and demonstrated in accordance with this regulation.If it involves adjustments to funds or construction period, the construction unit shall make adjustments according to the agreement.

Article 17:The construction unit shall register the construction personnel of hazardous large projects, and the project leader shall perform their duties on the construction site.

The full-time safety production management personnel of the project shall conduct on-site supervision on the implementation of the special construction plan.For those who do not follow the special construction plan, they shall require immediate rectification and report to the project leader in a timely manner.The project leader shall promptly organize rectification within a specified period of time.

The construction unit shall carry out construction monitoring and safety inspections on major hazardous projects in accordance with regulations.If an emergency situation endangers personal safety is discovered, it shall immediately organize the operators to evacuate the hazardous area.

Article 18:The supervising unit shall prepare supervision implementation rules in conjunction with the special construction plan for hazardous large projects, and conduct special inspections and inspections of the construction of hazardous large projects.

Article 19:If the supervising unit discovers that the construction unit has not carried out construction according to the special construction plan, it shall require it to carry out rectification;If the circumstances are serious, they shall be required to suspend construction and promptly report to the construction unit.If the construction unit refuses to rectify or stop construction, the supervising unit shall promptly report to the construction unit and the local housing and urban-rural construction department where the project is located.

Article 20:For hazardous projects that require third-party monitoring in accordance with regulations, the construction unit shall entrust units with corresponding survey qualifications to conduct monitoring.

The monitoring unit shall prepare a monitoring plan.The monitoring plan shall be reviewed and signed by the technical leader of the monitoring unit, stamped with the unit's official seal, and submitted to the supervising unit before implementation.

The monitoring unit shall carry out monitoring in accordance with the monitoring plan, timely report the monitoring results to the construction unit, and be responsible for the monitoring results;When abnormalities are found, they should be promptly reported to the construction, design, construction, and supervision units.The construction unit should immediately organize relevant units to take disposal measures.

Article Twenty-One Demands The construction unit and the supervision unit shall organize relevant personnel to carry out acceptance of dangerous and large projects that need to be accepted according to regulations.Those who pass the acceptance inspection can only proceed to the next process after being signed and confirmed by the project technical leader and chief supervising engineer of the construction unit.

After the acceptance of a major hazardous project is qualified, the construction unit shall set up an acceptance sign in a prominent position on the construction site, announcing the acceptance time and responsible personnel.

Article 22:In the event of a dangerous situation or accident in a major construction project, the construction unit shall immediately take emergency response measures and report to the competent department of housing and urban-rural development in the location of the project.Construction, survey, design, supervision and other units shall cooperate with the construction unit to carry out emergency rescue work.

Article 23:After the emergency rescue of a major hazardous project is completed, the construction unit shall organize the survey, design, construction, supervision and other units to formulate a project recovery plan, and conduct a post evaluation of the emergency rescue work.

Article 24:Construction and supervision units shall establish safety management records for major hazardous projects.

The construction unit shall include relevant materials such as special construction plans and reviews, expert argumentation, disclosure, on-site inspection, acceptance, and rectification in the archives management.

The supervising unit shall include relevant materials such as the implementation rules of supervision, special construction plan review, special inspection, acceptance, and rectification in the archives management.

Chapter 5 Supervision and Management

Article 25:The competent departments for housing and urban-rural development of local people's governments at or above the city level divided into districts shall establish an expert database, formulate an expert database management system, establish expert integrity archives, and disclose them to the public for acceptance of social supervision.

Article 26:The competent departments for housing and urban and rural construction of local people's governments at or above the county level or their affiliated construction safety supervision institutions shall conduct spot checks on hazardous large projects in accordance with the supervision work plan.

The competent departments for housing and urban-rural development of local people's governments at or above the county level or their affiliated construction safety supervision institutions may hire units and personnel with professional technical capabilities to inspect hazardous large projects through the purchase of technical services by the government, and the necessary expenses shall be guaranteed by applying to the local finance department.

Article 27:If the competent department of housing and urban-rural construction of the local people's government at or above the county level or its affiliated construction safety supervision institution discovers safety hazards in the supervision and random inspection of hazardous large projects, it shall order the construction unit to rectify them;If safety cannot be guaranteed before or during the elimination of major safety hazards, the operator shall be ordered to evacuate from the hazardous area or temporarily stop construction;For acts that should be subject to administrative penalties in accordance with the law, administrative penalty decisions should be made in accordance with the law.

Article 28:The competent departments for housing and urban-rural development of local people's governments at or above the county level shall include the punishment information of units and individuals in the bad credit records of construction safety production.

Chapter 6 Legal Liability

Article 29:If a construction unit commits one of the following acts, it shall be ordered to make corrections within a specified period of time and fined not less than 10000 yuan but not more than 30000 yuan;The directly responsible supervisor and other directly responsible personnel shall be fined between 1000 yuan and 5000 yuan:

(1)Failure to provide information on the surrounding environment of the project in accordance with this regulation;

(2)Failure to provide a list of major hazardous projects in the bidding documents in accordance with this regulation;

(3)Failure to timely pay the construction technical measures fees or corresponding safety protection and civilized construction measures fees for major hazardous projects in accordance with the construction contract;

(4)Failure to entrust a unit with corresponding survey qualifications to conduct third-party monitoring in accordance with these regulations;

(5)Failure to take measures to address abnormal situations reported by third-party monitoring units.

Article 30:If the surveying unit fails to explain the potential engineering risks caused by geological conditions in the surveying documents, it shall be ordered to make corrections within a specified period of time and punished in accordance with the"Regulations on the Administration of Safety Production in Construction Projects";The directly responsible supervisor and other directly responsible personnel shall be fined between 1000 yuan and 5000 yuan.

Article 31:If the design unit fails to specify the key parts and links involved in hazardous engineering in the design documents, and fails to provide opinions on ensuring the safety of the surrounding environment and construction safety of the project, it shall be ordered to make corrections within a specified time limit and fined not less than 10000 yuan but not more than 30000 yuan;The directly responsible supervisor and other directly responsible personnel shall be fined between 1000 yuan and 5000 yuan.

Article 32:If a construction unit fails to prepare and review a special construction plan for hazardous large projects in accordance with these regulations, the unit shall be punished in accordance with the"Regulations on the Administration of Safety Production in Construction Projects"and the safety production license shall be temporarily suspended for 30 days;The directly responsible supervisor and other directly responsible personnel shall be fined between 1000 yuan and 5000 yuan.

Article 33 If the construction unit commits any of the following acts, it shall be punished according to the Production Safety Law of the China and the Regulations on the Administration of Work Safety in Construction Projects:

(1)Failure to provide plan and safety technical disclosure to construction site management and operators;

(2)Failure to prominently announce major hazardous projects on the construction site and set up safety warning signs in hazardous areas;

(3)The full-time safety production management personnel of the project did not conduct on-site supervision on the implementation of the special construction plan.

Article 34:If a construction unit commits one of the following acts, it shall be ordered to make corrections within a specified time limit, fined not less than 10000 yuan but not more than 30000 yuan, and its safety production license shall be temporarily suspended for 30 days;The directly responsible supervisor and other directly responsible personnel shall be fined between 1000 yuan and 5000 yuan:

(1)Failure to conduct expert argumentation on special construction plans for hazardous large projects exceeding a certain scale;

(2)Failure to modify the special construction plan for hazardous large projects exceeding a certain scale based on expert argumentation reports, or failure to reorganize expert argumentation in accordance with this regulation;

(3)Failure to strictly organize construction according to the special construction plan, or unauthorized modification of the special construction plan.

Article 35:If a construction unit commits one of the following acts, it shall be ordered to make corrections within a specified period of time and fined not less than 10000 yuan but not more than 30000 yuan;The directly responsible supervisor and other directly responsible personnel shall be fined between 1000 yuan and 5000 yuan:

(1)The project leader fails to fulfill their duties on site or organize rectification within a specified time limit in accordance with these regulations;

(2)The construction unit fails to carry out construction monitoring and safety inspections in accordance with this regulation;

(3)Failure to organize the acceptance of major hazardous projects in accordance with these regulations;

(4)Failure to take emergency response measures when a dangerous situation or accident occurs;

(5)Failure to establish safety management records for major hazardous projects in accordance with this regulation.

Article 36 The supervision unit shall be punished in accordance with the Production Safety Law of the China and the Regulations on the Administration of Work Safety in Construction Projects if it commits any of the following acts:;The directly responsible supervisor and other directly responsible personnel shall be fined between 1000 yuan and 5000 yuan:

(1)The chief supervising engineer fails to review the special construction plan for hazardous large projects in accordance with this regulation;

(2)Discovering that the construction unit did not implement the special construction plan, did not require rectification or shutdown;

(3)When the construction unit refuses to rectify or stop construction, it fails to report to the construction unit and the local housing and urban-rural construction authority where the project is located.

Article 37:If a supervising unit commits one of the following acts, it shall be ordered to make corrections within a specified period of time and fined not less than 10000 yuan but not more than 30000 yuan;The directly responsible supervisor and other directly responsible personnel shall be fined between 1000 yuan and 5000 yuan:

(1)Failure to prepare supervision implementation rules in accordance with these regulations;

(2)Failure to carry out special inspections and inspections on the construction of major hazardous projects;

(3)Failure to participate in organizing the acceptance of hazardous projects in accordance with this regulation;

(4)Failure to establish safety management records for major hazardous projects in accordance with this regulation.

Article 38:If a monitoring unit commits one of the following acts, it shall be ordered to make corrections within a specified period of time and fined not less than 10000 yuan but not more than 30000 yuan;The directly responsible supervisor and other directly responsible personnel shall be fined between 1000 yuan and 5000 yuan:

(1)Engaging in third-party monitoring without obtaining corresponding survey qualifications;

(2)Failure to prepare monitoring plans in accordance with these regulations;

(3)Failure to carry out monitoring according to the monitoring plan;

(4)Failure to report abnormalities in a timely manner.

Article 39:If any staff member of the housing and urban-rural construction department of the local people's government at or above the county level or its affiliated construction safety supervision institution fails to fulfill their responsibilities for safety supervision and management of hazardous large projects in accordance with the law, they shall be punished in accordance with relevant regulations.

Chapter 7 Supplementary Provisions

Article 40:These regulations shall come into effect from June 1, 2018.

Departments of Housing and Urban Rural Development of all provinces and autonomous regions, Beijing Municipal Commission of Housing and Urban Rural Development, Tianjin Municipal Commission of Urban Rural Development, Shanghai Municipal Commission of Housing and Urban Rural Development, Chongqing Municipal Commission of Urban Rural Development, and Xinjiang Production and Construction Corps Bureau of Housing and Urban Rural Development:

In order to implement the"Regulations on the Safety Management of Sub projects with High Risks"(Order No.37 of the Ministry of Housing and Urban Rural Development)and further strengthen and standardize the safety management of sub projects with high risks in housing construction and municipal infrastructure projects(hereinafter referred to as"hazardous projects"), the relevant issues are hereby notified as follows:

1、Regarding the scope of hazardous projects

The scope of hazardous projects is detailed in Annex 1.The scope of hazardous projects exceeding a certain scale is detailed in Annex 2.

2、Regarding the content of the special construction plan

The main content of the special construction plan for major hazardous projects should include:

(1)Project overview:overview and characteristics of major hazardous projects, construction layout, construction requirements and technical guarantee conditions;

(2)Compilation basis:relevant laws, regulations, normative documents, standards, specifications, construction drawing design documents, construction organization design, etc;

(3)Construction plan:including construction schedule plan, material and equipment plan;

(4)Construction process technology:technical parameters, process flow, construction methods, operational requirements, inspection requirements, etc;

(5)Construction safety assurance measures:organizational assurance measures, technical measures, monitoring and monitoring measures, etc;

(6)Allocation and division of labor for construction management and operation personnel:construction management personnel, full-time safety production management personnel, special operation personnel, other operation personnel, etc;

(7)Acceptance requirements:acceptance standards, acceptance procedures, acceptance content, acceptance personnel, etc;

(8)Emergency response measures;

(9)Calculation sheets and relevant construction drawings.

3、About the attendees of the expert argumentation meeting

The attendees of the expert demonstration meeting for special construction plans for hazardous large projects exceeding a certain scale should include:

(1)Experts;

(2)The project leader of the construction unit;

(3)Technical leaders and relevant personnel of relevant survey and design units;

(4)Technical leaders or authorized professional technical personnel, project leaders, project technical leaders, personnel responsible for preparing special construction plans, full-time safety production management personnel and related personnel of the general contracting unit and subcontracting units;

(5)Chief Supervision Engineer and Professional Supervision Engineer of the Supervision Unit Project.

4、Regarding the content of expert argumentation

For special construction plans for hazardous large projects exceeding a certain scale, the main content of expert argumentation should include:

(1)Is the content of the special construction plan complete and feasible;

(2)Whether the special construction plan calculation sheet, verification basis, and construction drawings comply with relevant standards and specifications;

(3)Does the special construction plan meet the actual situation on site and ensure construction safety.

5、Regarding the modification of special construction plans

If the special construction plan for hazardous large projects exceeding a certain scale is concluded as"approved"after expert argumentation, the construction unit can refer to expert opinions to modify and improve it on its own;If the conclusion is"approved after modification", the expert opinion should clarify the specific modification content.The construction unit should make modifications according to the expert opinion and complete relevant review and review procedures before implementation.The modification situation should be promptly notified to the experts.

6、Regarding the content of the monitoring plan

The main content of the third-party monitoring plan for hazardous engineering projects should include project overview, monitoring basis, monitoring content, monitoring methods, personnel and equipment, measurement point layout and protection, monitoring frequency, warning standards, and monitoring results submission.

7、Regarding acceptance personnel

The acceptance personnel for hazardous engineering projects should include:

(1)Technical leaders or authorized professional technical personnel, project leaders, project technical leaders, personnel responsible for preparing special construction plans, full-time safety production management personnel and related personnel of the general contracting unit and subcontracting units;

(2)Chief supervising engineer and professional supervising engineer of the supervising unit project;

(3)Technical leaders of relevant survey, design, and monitoring units.

8、About Expert Conditions

The expert database established by the housing and urban-rural development competent department of the local people's government at or above the city level with districts shall meet the following basic conditions:

(1)Honesty and trustworthiness, upright style, and academic rigor;

(2)Engaged in relevant professional work for at least 15 years or with rich professional experience;

(3)Having a senior professional and technical title.

9、About Expert Database Management

The competent departments for housing and urban-rural development of local people's governments at or above the city level with districts shall strengthen the management of expert databases and regularly disclose the performance of experts to the society.For experts who fail to fulfill their argumentation responsibilities seriously or neglect their work, they shall be recorded as having a bad credit record.If the circumstances are serious, their expert qualifications shall be revoked.

The notice on the issuance of the"Safety Management Measures for Divisional and Subdivisional Projects with High Risk"(Jian Zhi[2009]No.87)shall be invalidated from June 1, 2018.

1、Foundation pit engineering

(1)Earth excavation, support, and dewatering works for foundation pits(trenches)with an excavation depth exceeding 3m(including 3m).

(2)Although the excavation depth does not exceed 3m, the geological conditions, surrounding environment, and underground pipelines are complex, or the earthwork excavation, support, and precipitation engineering of foundation pits(trenches)that affect the safety of adjacent buildings and structures.

2、Formwork and support system

(1)Various types of tool type formwork engineering:including sliding formwork, climbing formwork, flying formwork, tunnel formwork and other engineering.

(2)Concrete formwork support engineering:concrete formwork support engineering with a height of 5m or more, or a span of 10m or more, or a total construction load(the design value of the basic combination of load effects, hereinafter referred to as the design value)of 10kN/m2 or more, or a concentrated line load(design value)of 15kN/m or more, or a height greater than the horizontal projection width of the support and relatively independent and unrelated components.

(3)Load bearing support system:used for steel structure installation and other full hall support systems.

3、Hoisting and lifting machinery installation and dismantling engineering

(1)Using unconventional lifting equipment and methods, and lifting projects with a single lifting weight of 10kN or more.

(2)The project of using lifting machinery for installation.

(3)Installation and dismantling engineering of lifting machinery.

4、Scaffolding engineering

(1)Construction of floor standing steel pipe scaffolding with a height of 24m or above(including lighting well and elevator well scaffolding).

(2)Attached lifting scaffolding engineering.

(3)Cantilevered scaffolding engineering.

(4)High altitude work basket.

(5)Unloading platform and operation platform engineering.

(6)Irregular scaffolding engineering.

5、Demolition engineering

Demolition projects that may affect the safety of pedestrians, transportation, power facilities, communication facilities, or other buildings and structures.

6、Underground excavation engineering

Tunnel and chamber engineering constructed using mining, shield tunneling, and pipe jacking methods.

7、Other

(1)Construction curtain wall installation engineering.

(2)Installation engineering of steel structures, grid structures, and cable membrane structures.

(3)Manual excavation pile engineering.

(4)Underwater operation engineering.

(5)Installation of prefabricated concrete components for Prefabricated building.

(6)The use of new technologies, processes, materials, and equipment may affect the safety of engineering construction, and there are no national, industry, or local technical standards for sub projects.

(1)Using unconventional lifting equipment and methods, and lifting projects with a single lifting weight of 100kN or more.

(2)Installation and dismantling of lifting machinery with a lifting capacity of 300kN and above, or a total height of 200m and above, or a foundation elevation of 200m and above.

4、Scaffolding engineering

(1)Construction of floor mounted steel pipe scaffolding with a height of 50m and above.

(2)Attached lifting scaffold engineering or attached lifting operation platform engineering with a lifting height of 150m and above.

(3)Suspended scaffolding construction with a height of 20m or more for segmented scaffolding.

5、Demolition engineering
